Where does a defamatory post end up once someone publishes it?

Why act as soon as possible?

Defamation does not sit still. The longer it stays up, the more copies there are and the more people take it as true.

Nobody asked your permission. Something untrue about you has been published. It does not have to be a crime for you to want it gone.

What is the right to honour?

It is the right not to have false or disparaging information published about you that discredits you in the eyes of others. In Spain it is recognised by article 18.1 of the Constitution and set out in Organic Law 1/1982, alongside the right to privacy and to your own image. It does not only protect the famous: it covers anyone, and companies too as far as their reputation is concerned.

When is a post considered a breach of my right to honour?

When it spreads false facts about you, or expressions that discredit you, with no public interest to justify it. Who says it, with what intent, and whether they checked the information before publishing it all count. Harsh criticism of a service does not breach your honour; accusing you of something you have not done does.

What is the difference between insult, slander and defamation?

Slander (calumnia) is accusing someone of a crime in the knowledge that it is false. Insult (injuria) is harming their dignity or their good name. Both appear in the Spanish Penal Code, in articles 205 to 216. “Defamation” is the everyday word used for both and is not a separate offence in Spain. To request removal, your case does not need to fit any of the three.

Can I ask for a news story that is true but harms me to be taken down?

Not on right to honour grounds: if the information is true and of public interest, freedom of information prevails. What you can ask for is that it stops appearing when your name is searched, once time has passed and the information has lost relevance, which is what is known as the right to be forgotten. When a case like that reaches us, we tell you before you pay anything.

What do I need to get started?

The link to the post or a screenshot of where you saw it. If you know which outlet, account or forum published it, all the better, but it is not essential: with your name we can find the rest. There is nothing else you need to prepare.

Do I have to report it to the authorities before asking for removal?

No. A claim to the platform or the outlet is a separate route from a criminal complaint and does not depend on it. You can do both at the same time, and the case file we prepare is useful if you decide to report it later.

Who decides whether the post is removed?

The platform, the outlet or, when there is nobody else to deal with, the provider hosting the website. We prepare the claim on the right legal grounds and follow it up, but the final decision is not ours. If it is not achieved, the amount stays as credit.

Can an anonymous comment be removed?

Yes. To claim with the platform you do not need to know who wrote it: the claim is about the content. Identifying the author is only necessary if you want to go down the court route, and that is a separate decision.
